PURPLE BOX MOBILE KIDS SPA — EVENT LIABILITY WAIVER & RELEASE (FLORIDA)

Purple Box Mobile USA LLC d/b/a Purple Box Mobile Kids Spa (“PBM”)
IMPORTANT: You must be at least 18 years old to sign this Agreement. A separate waiver is required for each child and each event/party.

1) Definitions

• “Event” means the specific PBM party/date you are booking/attending and any time you and/or your child(ren) are on or around PBM’s bus, set-up area, entry/exit steps, and nearby party area.

• “Released Parties” means PBM, Purple Box Mobile USA LLC, its owners, members, managers, employees, contractors, volunteers, hosts, agents, affiliates, representatives, and any third parties working with PBM (including photographers/videographers/influencers), and the property owner/venue where PBM is located (to the extent applicable).

2) Acknowledgment of Activities / Services (Entertainment Only)

PBM provides children’s spa-themed party entertainment services. PBM services are for entertainment purposes only and are not medical or professional cosmetology/esthetic services. PBM does not diagnose or treat any condition. PBM may use kid-friendly cosmetics and spa-themed products (examples may include nail polish, lip gloss, makeup, glitter, lotion, face masks/sheet masks, hair accessories, etc.). PBM does not provide medical supervision.

3) Assumption of Risk

I understand and acknowledge that participation in or presence at the Event may involve risks, including, without limitation: slipping/tripping/falling; minor cuts/scratches; allergic reactions or sensitivities (including to cosmetics, fragrances, lotions, nail products, soaps, masks, snacks, candy, beverages, or craft materials); choking hazards; crowd-related bumps; and other known or unknown risks that may cause injury, illness, property damage, or, in rare cases, serious injury.

I voluntarily choose to allow my child(ren) and any accompanying adults to enter PBM’s bus/premises and/or participate in activities. I assume all risks, known and unknown, to the fullest extent permitted by Florida law.

4) Health / Allergies / Parent Responsibility

I understand it is my responsibility to:

• disclose any allergies, sensitivities, medical conditions, behavioral concerns, or dietary restrictions for myself and/or my child(ren);

• supervise my child(ren) before, during, and after the Event (including entry/exit of the bus); and

• ensure my child(ren) follow PBM staff instructions and safety rules.

PBM may refuse or stop any service for safety, behavioral, or health reasons.

5) RELEASE OF LIABILITY (INCLUDING NEGLIGENCE) / COVENANT NOT TO SUE

In consideration of being permitted to enter PBM’s bus/premises and/or participate in the Event, I, on behalf of myself and my child(ren), hereby release, waive, and forever discharge the Released Parties from any and all claims, demands, causes of action, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or related to the Event, including without limitation claims for personal injury, allergic reaction, illness, death, or property damage.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS ARISING FROM THE NEGLIGENCE (WHETHER ACTIVE OR PASSIVE) OF ANY OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW.
This Release does not apply to gross negligence or intentional misconduct to the extent such claims cannot be released under Florida law.

I agree I will not sue or bring any claim against any Released Party for any matter released in this Agreement.

6) Indemnification (Narrow / Event-Related)

To the fullest extent permitted by Florida law, I agree to defend, indemnify, and hold harmless the Released Parties from and against any third-party claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from or related to:

• my or my child(ren)’s acts or omissions at the Event;

• violation of PBM rules/instructions; or

• any false, incomplete, or omitted information I provide (including allergy/health information).

7) Add-Ons / Special Activities (Included in This Waiver)

This Agreement applies to all PBM services and activities during the Event, including any package inclusions and add-ons, which may include (without limitation): mini manis/pedis, facials/sheet masks, glitter makeup, karaoke/dancing, craft/DIY stations, snacks, candy, beverages, pizza, cookies, cotton candy, themed experiences (e.g., K‑Pop/Swiftie/Pop Mix), party favors/goodie bags, and any similar entertainment activities.

8) Photo & Video Release (With Opt‑Out)

Unless I select the “DO NOT PHOTO/FILM” opt‑out checkbox on the form, I grant PBM permission to photograph, record, and/or film my child(ren) and accompanying adults during the Event, and to use such photos/videos for lawful business purposes, including marketing, advertising, website, social media, online content, and collaborations. This includes media captured by PBM staff and/or third parties working with or on behalf of PBM (including photographers/videographers/influencers).

I understand:

• PBM owns all rights in the photos/videos it captures or commissions to the extent permitted by law;

• the content may be used in any media now known or later developed;

• no compensation is owed to me; and

• I release the Released Parties from claims related to the authorized use of such images/recordings.

Opt‑out clarification: If you select the “DO NOT PHOTO/FILM” opt‑out, PBM will make reasonable efforts to avoid close‑up use of your child(ren) and accompanying adults; however, we cannot guarantee you will not appear in incidental background or crowd footage.

9) Transportation / Supervision

PBM does not provide transportation of guests during the Event unless PBM separately and expressly agrees in writing. I am responsible for ensuring my child(ren) are dropped off/picked up by an authorized adult and are supervised at all times.

10) Severability

If any provision of this Agreement is held unlawful or unenforceable, the remaining provisions will remain in full force and effect.

11) Governing Law / Venue (Florida)

This Agreement is governed by Florida law. Any dispute must be brought in a court of competent jurisdiction in the State of Florida, and I consent to such jurisdiction and venue.

12) Per‑Event Agreement / Entire Agreement

This waiver applies only to the specific Event for which it is submitted. A new waiver is required for each Event. This Agreement is the entire agreement regarding the subject matter and supersedes any prior statements or understandings.

ACKNOWLEDGMENT

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS (INCLUDING THE RIGHT TO SUE), AND I SIGN IT FREELY AND VOLUNTARILY.
