ENTER Purple Box Mobile Kids Spa premises (bus) at YOUR OWN RISK. Whether you signed the liability waiver or not, by entering the property (PBM Bus) you assume all risk and liability. The business, affiliates, owners, employees, third party, independent contractors and customers are NOT RESPONSIBLE for injuries, accidents, slip & falls, choking, allergies, missing child, kidnap and or death. YOU knowingly and freely assume all such risks both known and unknown, even if arising from the negligence of the releasees and/or others. By entering the property, you agree to adhere to this notice and assume all liabilities & responsibilities for yourself, your guest(s), minor children/ ward(s) including all participants and non- participants. Non-participants are any and all persons who are inside the spa but not taking part in spa services and activities.

 

PURPLE BOX MOBILE KIDS SPA SERVICES ARE NOT PERFORMED BY A LICENSED COSMETOLOGIST, ESTHETICIANS AND IS FOR ENTERTAINMENT PURPOSES ONLY. We do not used powered equipment, cuticles tools or harsh chemical during our mini manicure and mini pedicure services. We will attempt to use products that are considered safe for children however, we cannot guarantee that there will not be an allergic reaction to products being used for skin, hair, and nails. Unfortunately, skin damage or minor allergic reactions can result from these kinds of activities. Purple Box Mobile Kids Spa is not responsible for any allergic reaction due to any services, actives, costumes or consuming any food, candy and beverage before, during or after the party, event, appointment, classes or camp. Purple Box Mobile Kids Spa is not responsible to any allergic reaction caused by our party favors or cosmetics which includes nail polish, lip gloss, lip stick, eye shadow and nail sticker or to any party favors or anything given from Purple Box Mobile Kids Spa to any child. It is the responsibility of the guest’s or parent guardian to inform Purple Box Mobile Kids Spa staff of allergies or any dietary restrictions. Purple Box Mobile Kids Spa is not responsible to any slip or fall accidents or any accidents in general. Purple Box Mobile Kids Spa is not responsible to make sure your child gets picked up and dropped off by a parent or legal guardian. Purple Box Mobile Kids Spa will not be responsible to any missing child. Purple Box Mobile Kids Spa is not responsible to any transmitted diseases, viruses, head lice and or bacteria. Purple Box Mobile Kids Spa staff are trained professionals and will work to ensure that you and guest are treated in the most respectable manner and in a safe environment. 

In consideration of being allowed to enter into the spa and/or participate in any parties or programs at Purple Box Mobile Kids Spa, the undersigned, on his or her own behalf and on behalf of the minor identified acknowledges, appreciates and agrees that: 1. Services can be hazardous and dangerous. I understand that these activities can result in serious injury to the person or child. I assume any and all risk and damage or injury while on the Purple Box Mobile Kids Spa bus. 2. I am aware of the risk, hazards and danger of personal injury, allergic reactions, choking, disability and/or death as a result of participation at Purple Box Mobile Kids Spa. 3. I have read a copy of the rules of the spa and understand that it is my responsibility to ask questions about them if necessary. I also understand, it is my responsibility to ensure my child(ren) understand the rules. It is my responsibility to monitor my child(ren) and my own activities. I will bring any observation of the rules being broken to the attention of a Purple Box Mobile Kids Spa staff member. I certify that I and/or my child(ren) are in good health and that I and/or my child(ren) have no physical limitations, which would preclude safe participation at Purple Box Mobile Kids Spa. 4. In consideration for the admission of my child, I hereby release, waive and forever discharge and covenant not to sue Purple Box Mobile USA LLC d/b/a Purple Box Mobile Kids Spa and its owners, agents, employees, officers, directors, trustees, binding heirs, executors, administrators, assignees, and all other persons or entities acting on its behalf, from any and all claims, actions, damages, liability, cost or expense including attorney fees which are related to or arise out of or in any way connected to my child(ren) participation or use of the facility including those that may arise out of the negligence of other participants or visitors. 5. I acknowledge that my or my child(ren)’s participation in activities at Purple Box Mobile Kids Spa is strictly voluntary. I hereby certify I am over 18 years of age; I have carefully read the foregoing covenants not to sue and acknowledge that I understand and agree to all of the above terms and conditions. Prior to signing this agreement, I have had an opportunity to ask any questions and I am aware that by signing this waiver and agreement, I am assuming all risks and potential injury while on the premises. Lastly, I expressly represent that I have the authority, expressed or implied, to bring said child(ren) to Purple Box Mobile Kids Spa prior to signing this agreement and I am assuming all risks and potential injury while on Purple Box Mobile Kids Spa premises.

I, the undersigned, parent/ guardian assume all risk and hazards incidental to participating in the activity and hereby waive, release, absolve, indemnify, and agree to protect, defend, and hold harmless. Purple Box Mobile Kids Spa, owners, staff and participants for any claim arising out of any injury to myself/ child to the fullest extent allowed by law. I, the undersigned, parent/ guardian of the participant, am fully aware of the potential dangers and risk inherent in this activity, including physical injury, death or other consequences that may arise or result directly or indirectly from participation in all salon and spa services and activities. “If any provision of this clause is held unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then any such provision shall be deemed sever able from this clause and shall not after the validity and enforceability of the remaining provisions.”

Minor (Child) Photo Release Form:

I, the parent or legal guardian of the child/ children mentioned above grant Purple Box Mobile Kids Spa, my permission to use photographs taken during this event for any legal use, including but not limited to: publicity, copyright purposes, illustrations, advertising, web content, likeness, image, voice, and/ or appearances as such may be embodied in any pictures, photos, video recordings, digital images, and the like, taken or made on behalf of Purple Box Mobile Kids Spa, party activities. Furthermore, I understand that no royalty, fee or other compensation shall become payable to me by reason of such use.  Purple Box Mobile USA LLC d/b/a Purple Box Mobile Kids Spa I agree that Purple Box Mobile Kids Spa, has complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose consistent with Purple Box Mobile USA LLC business. These uses include, but are not limited to, reprints, publications, advertisements, social media, and any promotional materials in any medium now known or later developed, including the internet. I acknowledge that I will not receive any compensation for the use of such pictures, etc., and hereby release Purple Box Mobile USA LLC, from all claims which are in any way connected with such use. I have read and understood this consent and release.

Makeup Consent

As part of the Purple Box Mobile Kids Spa party experience age-appropriate makeup and spa treatment products will be applied. Purple Box Mobile Kids Spa parties are for entertainment purposes only. We exercise special care in being sanitary and using kid-friendly products that are especially sensitive to young skin. Although, we make no claims of being licensed professional technicians, cosmetologists, or estheticians. Therefore, we take no responsibility for any allergic reactions of any party guest. It is the responsibility of the parent or guardian hosting the party to alert Purple Box Mobile Kids Spain advance of any allergies that any of the children may have. Purple Box Mobile Kids Spa reserves the right to the right to refuse services on any child, for any reason, that we feel may impose a health risk to others. I have read and understood this consent and release.
Food Allergy
Your child will be participating in various activities on the Purple Box Mobile Kids Spa Bus. Additionally, some of the activities involve food products as part of the experience. Purple Box Mobile Kids Spa takes every precaution to ensure that our guests are safe. Purple Box Mobile Kids Spa will not be responsible for any allergic reactions or life-threatening incidents including death that could occur. If your child has any known food allergies that may prevent her from participating in these activities, if possible, we will try to provide an alternative option per your request. I have read and understood this consent and release. By checking the box and booking a party with Purple Box Mobile Kids Spa, confirms I have read and understood this consent and release and assume all responsibility as set herein.
Transportation

Transportation is not included with the Purple Box Mobile Kids Spa bus and we do not transport guests during the party.  The bus is parked out front of the hosting person/parent(s) home or venue with the address provided on the Registration Form. 

 

By signing below, I and/or child, agree to each above rule and will comply with the rules. I will bring any observation of the    

rules being broken to the attention of a Purple Box Mobile Kids Spa staff member. This waiver once signed/ dated will

apply to any date and time (past, present, future) you enter our facility even if you did not update your current/past

waiver to a future/current date or the date you are attending. It will serve as an always and permanent waiver of Liability-

Release Form- Indemnification Agreement

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
